Haynes Boone Partner Lee Johnston was quoted in Law360 after music publishers recently petitioned the U.S. Supreme Court to review a Fourth Circuit ruling — with music companies asking for clarity on the scope of liability for internet service providers for online piracy and Cox asking whether it can be responsible for copyright infringement for merely providing an internet connection.
Johnston said the standards of liability for contributory infringement could use more clarity, given the stakes of the case.
"The notion of secondary liability yielding this type of dollar amount is breathtaking," he said. "That catches the attention of every ISP big and small when you start talking about that kind of liability. That's game-changing liability."
