Haynes Boone Partner David Bell spoke with Managing IP as many are starting to spot content that appears to be generated by artificial intelligence, including correspondence sent by parties who are in a dispute with their clients.
Bell told Managing IP that he hasn’t seen any demand letters that seem to be generated by AI.
By contrast, he’s seen letters and emails that were so poorly written that he suspects they weren’t generated by AI.
“Generative AI probably would have done a better job,” he says, noting that these letters contained both factual and grammatical mistakes.
He says he’s planning on responding to this by focusing on the claims not having much merit rather than addressing the errors.
He has pointed out opposing counsel’s mistakes in the past.
However, this is only to make it clear that the firm is paying attention and to make the other side’s clients aware of the errors.
“It’s just a matter of strategy. It’s not about being a jerk but about putting my clients in the best situation.”
