Our Experience
- Represented one of the world's largest restaurant franchisors in litigation arising from the closure of an entire market area, which involved a variety of contract and tort claims seeking as much as $50 million. Prevailed on all claims after a week-long bench trial, recovered all requested attorneys’ fees and upheld the judgment on appeal to the U.S. Court of Appeals for the Fifth Circuit.
- Represented major oil drilling company in patent infringement lawsuit involving cutting-edge patented technology for hydraulic fracturing. Case settled during jury deliberations following over one-week jury trial in the Northern District of Texas.
- Represented real estate developer in more than $100 million lawsuit in Dallas County District Court involving contract for the purchase of high-profile real estate in the legacy district of Plano, Texas.
- Represented investment fund in a series of lawsuits in Midland, Texas district court and the United States Bankruptcy Court for the Western District of Texas in dispute involving the wind up of an oil and gas venture.
- Successfully defended patent infringement claims related to data-compression software, obtaining a jury verdict of non-infringement in trial in the Eastern District of Texas while invalidating other patents through inter partes review proceedings in the United States Patent and Trademark Office.
- Won defense verdict for Korean manufacturer and its founder (E.D. Tex.). After deliberating less than two hours, the jury returned a verdict of no-infringement, no tortious interference and no conspiracy. The plaintiffs sought over $100 million in actual and punitive damages but on appeal to the Federal Circuit, resulted in no recovery. The jury also awarded the founder $1.36 million—every penny sought—on his breach-of-contract claim.
- Defended HCC in federal court jury trial regarding construction of a community college on property subject to deed restrictions within a mixed-use development wherein the developer alleged constitutional taking of the developer’s property rights. The jury found for HCC, awarding $0 to the developer.
- Represented energy company in a bench trial as part of an adversary proceeding in the bankruptcy of producer claiming our client was not fulfilling certain obligations in Delaware Bankruptcy Court. The court found at trial that our client was not required to fulfill alleged obligations, resulting in our client negotiating a favorable outcome to the adversary proceeding.
- Defended oil and gas producer Ovintiv against claims of underpaid royalty payment in a state court bench trial in McKenzie County, North Dakota. At trial, the court found that the State had failed to present adequate, persuasive evidence that Ovintiv had underpaid royalties, resulting in a favorable judgment awarding no damages to the State.
- Defended a foreign intellectual property firm in both federal and state court against alleged trademark infringement, unfair competition, misappropriation of trade secrets, unjust enrichment, intentional interference with economic relations and conversion. The federal matter proceeded to trial where a unanimous jury verdict in favor of our client was awarded. The district court declared our client the owner of the mark in question and found that the plaintiff had committed trademark infringement and unfair competition, resulting in a take-nothing judgment in favor of our client.
- Achieved a complete defense verdict for our client after a two-week district court trial involving alleged breach of contract and fraud related to a prototype which our client ordered. The jury returned a take-nothing judgment in our client’s favor on all counts.
- Successfully represented a major energy company in a five-week jury trial involving alleged personal injury and property damage from a neighborhood cluster of asthma, lupus and autoimmune diseases. Plaintiffs’ counsel sought multi-million-dollar damages, including punitive damages. The jury returned a verdict for our client on all claims.
- Successfully represented one of the world's largest publicly traded energy companies against a landowner claiming breach of an oil and gas lease's implied covenant to accommodate the landowner's use of his surface. The landowner obtained a temporary injunction against the drilling of 12 wells, sidelining over $100 million for drilling the wells, and sought to make the temporary injunction permanent as well as actual and punitive damages. The temporary injunction was dissolved, permanent injunction denied and the judgment entered was in favor of our client.
- Successfully secured judgment for engineering, fabrication and construction client following a five-week jury trial in the U.S. District Court for the Southern District of Texas-Galveston Division. The judgment awarded our client $20.8 million in actual damages and $14.3 million in prejudgment interest based on the jury’s findings that defendant breached three separate construction contracts. The judgment also provided that the defendant should take nothing on its $65 million breach of contract counterclaims.
- Obtained take-nothing summary judgments against 23 plaintiffs in significant permissive appeal that vindicated a premises owner’s right to immunity under Texas’s workers’ compensation laws involving personal-injury claims arising from an explosion.
- Obtained a favorable outcome relative to the amount in controversy in a state court jury trial in Harris County, Texas regarding breach of contract and remanded ERISA claims.
- Secured a favorable outcome from a federal jury in the Southern District of Texas (Houston Division) regarding claims of employment discrimination, harassment, and retaliation.
- Represented individual facing first degree murder charges (mandatory life in prison) in a pro bono matter. After nearly two weeks trial, jury was hung and mistrial declared to client’s benefit.
