Philip Albert
Biography
Philip Albert is a partner in the Intellectual Property Practice Group of the San Francisco office of Haynes Boone. His practice focuses on patent prosecution, including interfacing with patent practitioners in other countries, setting up internal patent review processes so that limited resources are allocated to the most important inventions, evaluating patents of others for purchase, licensing, or design-around, and addressing intellectual property components of a larger transaction, acquisition or due diligence project. He has significant experience representing clients developing many critical technologies, including streaming, network protocols, network security, artificial intelligence, blockchain, animation, and the Internet of Things.
An engineer by training, Phil previously worked at NASA’s Jet Propulsion Laboratory and founded a company that produced semi-custom software and turnkey computer systems for accounting tasks and bank operations.
Having been deposed as patent prosecuting attorney many times, Phil brings that experience to the patent prosecution process so that issued patents are more likely to be more defensible in licensing or litigation.

- Prosecuted patent applications for personal health devices that led to a successful acquisition
- Obtained patents for a satellite communications company
- Worked with a wireless protocol company to create a portfolio of patents for 802.11 protocols
- Helped start an internal patent program from scratch for an animation company and obtain numerous patents on tools used throughout the industry
- Handled license negotiations for social gaming company against a large patent holder
- Handled a number of negotiations for university spin-outs to obtain exclusive rights from universities in exchange for spin-out interests
- Negotiated an exclusive patent license for utility technology provider
- Was on a team that successfully defended patent litigation related to LCD screens
- Advised institutional investor on investment in power plant operator involving intellectual property issues, international licensing issues, and licensing encumbrances
- Provided open source licensing advice and patent advice to a nonprofit developer of low-cost medical ventilators
- Negotiated technology licenses for a nonprofit arts museum for an art exhibit based on data collected from scientific space missions
- Successfully represented immigrant minors and immigrant victims of trafficking in obtaining permanent residency or securing legal rights to remain in the U.S. for eventual permanent residency
