Mills in National Law Journal: EPA Signals Potential Revisions to PFAS Drinking Water Rule

Haynes Boone Partner Clarissa Howley Mills spoke with The National Law Journal as the U.S. Environmental Protection Agency may seek to revise a Biden-era rule requiring drinking water utilities to filter out “forever chemicals.”

Mills said the EPA is unlikely to outright repeal the rule, as both industry and the Trump administration understand there should be some PFAS standards.

“The concern is the technology and the feasibility of how you implement those standards, how you get a water system—particularly a small water system for a very small community— to be able to afford these lower levels," Mills said.

The EPA's request for an abeyance signals the new administration is unsure how to handle the rule or the litigation and is buying itself more time to decide how to proceed, Mills said. She added the administration could revise the rule to either extend the compliance date, which is currently 2029, or loosen the restrictions on PFAS contaminants.
