Mills in National Law Journal: EPA Revisits Refrigerant Rules in Possible Boon to Grocers

Haynes Boone Partner Clarissa Mills spoke to National Law Journal after congressional Republicans introduced three separate resolutions to rescind a rule finalized by the EPA in October that also implemented the AIM Act. These rules places requirements on leak detection, repairs and recordkeeping on existing HFC refrigeration systems.

Mills told National Law Journal that there seems to be a bipartisan consensus that HFCs are a problem. The debate is over “solutions to managing that problem and … who should bear that burden and how should they bear it,” Mills added.

Mills said she does not expect the Trump administration to eliminate the rule outright since Congress has mandated that EPA address HFCs in the 2020 law.

“They might see this as an opportunity to make some changes to the rule—whether or not they want to see a full redo, I’m not sure,” Mills said. “At the end of the day, they will have to take some action to comply with the act. But the agency still has pretty broad-ranging discretion in what that action is and timeliness of the action.”
