Description: In a case involving a collegiate athlete’s eligibility to participate in a swimming competition, persuaded the Texas Supreme Court to expressly disapprove of the lower courts’ conclusion that the NCAA had no right to intervene in the litigation; the opinion significantly strengthened the NCAA’s hand in ensuring that its interests and the interests of its member-institutions are protected in athlete eligibility litigation across the country.
